§ 1 Scope
These Terms & Conditions apply to all purchases made through our online shop. They govern the business relationship between you and LIOR OG, the operator of this website, in the version valid at the time of your order. Any conflicting terms and conditions from the customer are not recognized unless expressly agreed in writing.
§ 2 Contracting Party, Language, Applicable Law
The contracting party is LIOR OG, Köllnerhofgasse 5/11, 1010 Vienna, Austria. The contractual language is English. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
§ 3 Conclusion of Contract
By placing an order on lior-jewellery.com, you are submitting a binding offer to conclude a purchase contract. Once you place your order, you will receive a confirmation email acknowledging receipt of your order. This confirmation does not constitute acceptance. The contract is concluded only when you receive a shipping confirmation email from us. Items not included in the shipping confirmation are not part of the contract.
§ 4 Right of Withdrawal and Returns
You have the right to cancel your order within 14 days without giving any reason. The withdrawal period is 14 days from the day you or a third party named by you (excluding the carrier) takes possession of the goods.
To exercise your right of withdrawal, you must notify us (LIOR OG, Köllnerhofgasse 5/11, 1010 Vienna, Austria, email: info@lior-jewellery.com) with a clear statement (e.g. email or letter). To comply with the withdrawal period, it is sufficient to send the notice before the 14-day deadline.
Consequences of Withdrawal:
We will refund all payments received from you, including standard delivery costs (excluding any additional costs for chosen alternative shipping methods), within 14 days from the day we receive your cancellation notice. Refunds are made using the same payment method as the original transaction, unless agreed otherwise. We may withhold the refund until we receive the returned goods or proof of their return, whichever comes first.
Returns must be sent within 14 days of your withdrawal notice. You bear the direct cost of return shipping. You are only liable for diminished value resulting from handling the goods beyond necessary inspection.
Custom-made or personalized items are excluded from the right of withdrawal.
§ 5 Delivery
Delivery is made to the address provided during checkout. Delivery dates are non-binding unless otherwise explicitly agreed. If an item is unavailable after an order is placed, we will inform you promptly. In the event our suppliers fail to deliver through no fault of our own, we may withdraw from the contract.
§ 6 Payment
We accept various payment methods, including credit card, Klarna, and Stripe. Payment is due upon order. For credit card payments, the card will be charged upon order placement. Klarna payments are subject to approval. Your personal data may be shared with Klarna or other payment providers for identity and creditworthiness checks.
§ 7 Prices
All prices include Austrian VAT. Shipping fees are listed separately during checkout.
§ 8 Retention of Title
Goods remain our property until full payment is received.
§ 9 Warranty and Liability
In the case of defects, statutory warranty rights apply. Claims for compensation are excluded except in cases of gross negligence or intent. This does not affect liability for damage to life, health, or under the Product Liability Act.
§ 10 Data Protection
We process personal data in accordance with applicable data protection laws. Your data is used to process your order and may be shared with shipping and payment providers. For more information, please refer to our Privacy Policy.
§ 11 Force Majeure
We are not liable for delays or non-performance due to circumstances beyond our control (e.g. natural disasters, pandemics, strikes). In such cases, we are entitled to delay performance or withdraw from the contract.
